# Terms of service
The deal, in plain English. These terms match the promises on [our promise page](https://websmarthq.com/our-promise/).
**Short answer:** The price is fixed and agreed before work starts. A deposit books your spot, and you see your homepage before you pay the balance. Business Plus is live within 10 working days of getting your content. Your domain, content, Google profile and analytics are in your name, there's no lock-in, and New Zealand law applies.
## Who these terms are between
These terms are between Web Smart HQ, a trading name of NJD Limited, based in Auckland ("we", "us"), and the person or business we do work for ("you").
Your quote and these terms together make up our agreement. If your quote says something different from these terms, the quote wins for your job.
## Your price
Every job has a fixed price, agreed before any work starts. Your quote lists what's included. Our prices are shown + GST.
If you ask for something that isn't in your quote, we'll tell you the price first. Nothing extra goes on your bill without your yes.
When and how you pay is confirmed in your quote.
## Deposit, and seeing your homepage first
A deposit books your spot. You pay the balance once you've seen and approved your homepage.
For website builds, you see your homepage design before you pay the balance. If it isn't right, tell us what to change.
## Timing
Business Plus is live within 10 working days of getting your content: your logo, photos and business details. The clock pauses while we're waiting on you, for example for an answer or an approval.
Business Lite is usually quicker. For other work, the timing is set out in your quote.
## Your part
You give us the content we need and tell us if any details are wrong. You confirm you have the right to use the logos, photos and text you send us.
If you're slow to send something, that pauses the timeline. It doesn't change the price.
## What you own
Your domain, content, Google profile and analytics are in your name. We host the site, and you can move it any time. Anything you send us stays yours.
## Hosting, domain and the first year
Business Lite and Business Plus include your domain, hosting with SSL, and support and small updates for the first year.
After year one, hosting and your domain continue at a monthly rate we agree with you before renewal. No surprises: we remind you before anything renews. You can renew with us, or move your site somewhere else.
## No lock-in, and leaving
There's no lock-in contract. You can leave any time. When you do, we hand over your logins so you can carry on without us.
## Rankings and results
We don't guarantee rankings, leads or a number of calls. Nobody can guarantee the top spot on Google, and Google says so. We promise to do the work we've agreed, with reasonable care and skill, and to tell you plainly what we did.
## Replies and hours
We reply within 2 business days. Our hours are Monday to Friday 8am to 6pm, and Saturday 9am to 6pm, New Zealand time. The best way to reach us is hello@websmarthq.com.
## If something goes wrong
Tell us. Email us what's wrong, and we'll work with you to put it right.
## Your rights under New Zealand law
If you're a consumer, the Consumer Guarantees Act 1993 gives you rights that these terms don't take away. The Fair Trading Act 1986 applies too.
Nothing in these terms limits any right the law says can't be limited.
These terms are governed by New Zealand law, and New Zealand courts deal with any dispute.
## Changes to these terms
We may update these terms. The version that applies to your job is the one in place when you accept your quote. This version was updated on 4 October 2026.
